The PNG Investment Promotion Authority (IPA) Act:
‘A company incorporated overseas that commences to carry on business in Papua New Guinea must apply for registration as an overseas company within one month.
‘A foreign or an overseas incorporated company is a company that is incorporated overseas but registered in PNG as an overseas company.|
‘This can be a company incorporated by either foreigners or citizens. The overseas company, after registration with the office of the Registrar of Companies will also be required to be certified as a foreign enterprise by the Investment Promotion Authority in accordance with the Investment Promotion Act 1992. This also apply to companies incorporated in PNG but owned or managed and controlled by foreigners.
‘An overseas company that fails to apply for registration as an overseas company under the Companies Act 1997 commits an offence and the company and every director can be prosecuted.
‘All Foreign Enterprises wishing to conduct business in Papua New Guinea must apply for a formal IPA certificate. A foreign enterprise is a business entity which is wholly owned or that is 50 percent or more owned or controlled and managed by non-citizens.
‘It is an offence under Section 41 of the Act for a foreign enterprise to operate without an IPA certificate, carry on business in a Reserved activity, or fail to comply with a Term or Condition of Certificate as issued. A penalty of up to K100,000.00 may be imposed or a default penalty not exceeding K10,000.00.’
PNG Kokoda Track Authority Commercial Operations License Conditions 2012
‘3.2 (c) It is the tour operator’s responsibility to ensure the compulsory Investment Promotion Authority (IPA) Company registration is maintained. Any lapse in IPA registration will cause this license to be revoked.
Unfortunately the PNG Kokoda Track Authority has lost contol of their own licensing system – they now issues trek permits to anybody who turns up with cash or a cheque. This is evident in the fact that they have 37 Licensed Tour Companies on their website howver there are now at least 57 operators marketing and leading treks.
The dysfunction and corruption within the authority has been well documented over recent years.
Caveat Emptor
The onus now rests on prospective trekkers do adopt the old Latin proverb of Caveat emptor (Let the buyer beware) and conduct their own due diligence on the Kokoda tour operator they choose.
Those who choose an operator who does not comply with the IPA Act risk jeopardising any potential Travel Insurance claims and Public Liabilityh Insurance cover.
Military – Eco Tour Operators
Companies owned by former army servicement understand military strategy, the phases of war (Advance-Attack-Defence-Withdrawal); the principles relevant to each phase; and how they relate to battlesites across the Kokoda Trail – as a result their presentations are more informative. They are also experienced expedition leaders with expertise in remote area survival, communications, and wilderness first.
Eco-tour operators focus more on the envirnment and local culture and generally rely on written texts or podcasts for military heritage briefings and presentations.
